ARTICLE 14. — (Right of access).
1. El titular de los datos, previa acreditación de su identidad, tiene derecho a solicitar y obtener información de sus datos personales incluidos en los bancos de datos públicos, o privados destinados a proveer informes.
2. The person responsible or user must provide the requested information within ten calendar days of being formally notified. Once the deadline has expired without the request being satisfied, or if the report is submitted but deemed insufficient, the action for the protection of personal data or habeas data provided for in this law shall be expedited.
3. The right of access referred to in this article may only be exercised free of charge at intervals of not less than six months, unless a legitimate interest to that effect is accredited.
4. The exercise of the right referred to in this article in the case of data of deceased persons shall correspond to their universal successors.
ARTICLE 16. — (Right of rectification, update, or suppression).
1. Every person has the right to have their personal data included in a data bank rectified, updated, and, when applicable, suppressed or subjected to confidentiality.
2. The person responsible for or user of the data bank must proceed to the rectification, suppression, or update of the personal data of the affected party, performing the necessary operations for this purpose within a maximum period of five business days of receiving the claim from the data subject or noticing the error or falsehood.
3. Failure to comply with this obligation within the term agreed in the preceding subsection will enable the interested party to promote without further delay the action for protection of personal data or habeas data provided for in this law.
4. In the event of assignment or transfer of data, the person responsible for or user of the data bank must notify the rectification or suppression to the assignee within five business days of the data processing being carried out.
5. Suppression does not proceed when it could cause damage to the rights or legitimate interests of third parties, or when there is a legal obligation to preserve the data.
6. During the process of verification and rectification of the error or falsehood of the information in question, the person responsible for or user of the data bank must either block the file or state, when providing information relative to it, the circumstance that it is under review.
7. Personal data must be kept during the terms provided in the applicable provisions or, where appropriate, in the contractual ones between the person responsible for or user of the data bank and the data subject.
